End User License Agreement

This End User License Agreement ("Agreement") is between you and the developer of the Harrogate Plaques App ("Developer") and governs use of this app made available through the Google Play Store. By installing the Harrogate Plaques App ("Application"), you agree to be bound by this Agreement. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Harrogate Plaques App.

1. Scope of License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes. You may only use the Application on devices that you own or control.

 

2. Privacy

The Harrogate Plaques App Privacy Policy explains how the Application uses your information. You agree to the use of your data in accordance with the privacy policy.

 

3. Restrictions on Use

You agree that you will not, and will not allow any third party to:

• copy, sell, license, distribute, transfer, modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Application or content that may be presented or accessed through the Application for any purpose, unless otherwise permitted.

• remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Harrogate Plaques App or any third party contained within or accessed in conjunction with or through the Application.

 

4. Intellectual Property

The App, logo, photos, walking routes, descriptions and directions are Harrogate Plaques property and are protected by the prevailing intellectual property laws.

 

5. Limitation of Liabilities

You understand and agree that the Developer is not liable to you, or any third party, under any theory of liability for any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by you, or any third party, through your use of the application, including any loss of data or damage to your mobile device.

6. Disclaimer of Warranties

• You understand and agree that your use of the application is at your sole discretion and risk and that the application is provided on an "as is" and "as available" basis without warranty of any kind.

• You are solely responsible for any damage to your mobile device, or other device, or loss of data that results from your use of the application.

• The Developer disclaims all warranties and conditions of any kind, whether express or implied, to the fullest extent permitted by law.

• This Agreement and its Privacy Policy shall be construed, governed and take effect in accordance with English law.
